We helped our client to identify a Right of Way past the front door of an £8 million country house standing in its own grounds.
Expert reports were exchanged covering diminution in value as a result of the Right of Way. We formed the view based on a dual approach (loss of value and cost of remedy) that the diminution was of the order of 30 per cent.
The opposing expert formed the view that the correct figure was around 10 per cent, and so the matter was settled at Mediation on the basis of 20 per cent.
