Savills was instructed by Dentons' Construction Disputes Team to prepare expert witness evidence on behalf of one of the defendants / Part 20 claimants in this complex construction dispute concerning Accolade Park in Avonmouth, Bristol.
This multi-faceted dispute was between six main parties and concerned seven different expert disciplines (valuation being one of these).
The dispute centred on the largest wine bottling production facility in Europe, a production facility and logistics warehouse of circa 870,000 sq ft. The construction issues put forward concerned the depth of the piling, the design and construction of the concrete slabs, the chemical composition of the concrete fill and the surface water drainage system.
The key issues being discussed between the five valuation experts included the assessment of relocation opportunities and the diminution in the market value of both the freehold and leasehold interests in the property.
Savills took part in mediation proceedings, contributed towards valuation expert meetings, helped prepare a joint statement between the five valuation experts and submitted an expert report to the court, followed by a supplemental report. Savills involvement in this dispute spanned the best part of 10 months and the matter was consequently settled out of court after the trial had commenced.
