Expert witnesses play a vital role in the resolution of disputes. They assist solicitors and the courts and, in the words of Dame Elizabeth Butler-Sloss (former President of the Family Division) “without them we (the judges) could not do our job”. Expert witnesses are exceptions to the usual rule that the opinions of witnesses are not admissible in court; they are needed where the issues are specialised and beyond the court’s experience.
The courts have become more stringent about the appointment and performance of experts.
