Case Law Update


It will be interesting to see how the courts approach rights to light over the course of the next year. Certainly the past 12 months have seen a sea-change in the attitudes of developers and a rise in the awareness of the general public in respect of the easement of light. It can also be argued that the courts are shifting their approach to both injury and damages; however, in the same breath, one could argue that they are only restating settled principles.
